Medical Disclaimer — Please Read Carefully

SleepWell is NOT a medical device. The App is designed for informational and wellness purposes only. It has not been evaluated, cleared, or approved by the FDA, EMA, or any other regulatory body.

Important Health Warnings

  • Sleep apnea detection — The App uses audio analysis and optional heart rate data to estimate potential apnea events. These results are not a diagnosis. Only a qualified healthcare professional using polysomnography (PSG) or an approved home sleep test (HST) can diagnose sleep apnea.
  • STOP-BANG questionnaire — The STOP-BANG screening tool included in the App is for informational purposes only. A high score does not confirm sleep apnea. Consult a sleep specialist for proper evaluation.
  • Bruxism and sleep talk detection — These features provide estimates based on audio patterns. They are not diagnostic tools and should not replace evaluation by a dentist or sleep specialist.
  • Sleep scores and readiness scores — These are algorithmic estimates based on available data. They do not measure clinical sleep quality and should not be used to make medical decisions.
  • Sleep stage estimation — Sleep stages shown in the App are approximations. Accurate sleep staging requires clinical polysomnography with EEG monitoring.

If you suspect you have a sleep disorder, experience excessive daytime sleepiness, loud snoring with observed pauses in breathing, or any other concerning symptoms, consult a healthcare professional immediately.

Do Not Use This App As a Substitute For

  • Professional medical advice, diagnosis, or treatment
  • Emergency medical services — call your local emergency number for medical emergencies
  • Prescribed CPAP, oral appliance, or other sleep apnea treatment
  • Clinical sleep studies (polysomnography)
  • Regular check-ups with your healthcare provider

1. Description of Service

SleepWell is a sleep tracking application that provides:

  • Audio-based sleep monitoring (snoring, breathing patterns, sleep talking, teeth grinding)
  • Sleep quality scoring and trend analysis
  • Smart alarm with wake-up optimization
  • Ambient sounds for relaxation
  • Personalized sleep coaching and insights
  • Optional Wear OS companion features

2. Eligibility

You must be at least 13 years old to use SleepWell. If you are under 18, you should use the App only with parental or guardian consent. The App is not designed for clinical use with children or infants.

3. Subscriptions and Payments

Free Features

SleepWell offers core sleep tracking features at no cost, including sleep score, snoring detection, and smart alarm.

Premium Subscription

  • Premium features require an active subscription (monthly or annual).
  • A free trial period may be offered. You will not be charged during the trial period.
  • The trial is available once per Google Play account.

Billing

  • Payment is processed through Google Play. All billing is governed by Google Play's Terms of Service.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel your subscription in Google Play Store > Subscriptions.
  • Refunds are handled by Google Play according to their refund policy.

Price Changes

We may adjust subscription prices. Existing subscribers will be notified in advance through Google Play. Price changes will not apply to your current billing period.

4. Acceptable Use

You agree to use SleepWell only for personal, non-commercial purposes. You agree not to:

  • Reverse engineer, decompile, or disassemble the App
  • Redistribute, sublicense, or sell the App or its content
  • Use the App to monitor another person without their knowledge and consent
  • Attempt to circumvent premium feature restrictions
  • Use the App in any way that violates applicable laws

5. Audio Recording and Consent

SleepWell uses your device's microphone to analyze sleep sounds. By using the monitoring feature, you acknowledge that:

  • Audio is processed locally on your device in real-time
  • Short audio clips of detected events (snoring, sleep talking) may be saved on your device
  • If you share a sleeping space, you should inform other individuals that audio analysis is active
  • You are responsible for complying with local laws regarding audio recording in your jurisdiction

6. Accuracy and Limitations

No Guarantee of Accuracy

SleepWell's measurements and analyses are estimates based on audio signals, accelerometer data, and optional heart rate data from wearable devices. Results may be affected by:

  • Environmental noise (fans, traffic, pets, other people)
  • Device placement and microphone quality
  • Individual physiological differences
  • Wear OS sensor limitations

Do not rely on SleepWell's outputs for any health-related decisions. Always consult qualified healthcare professionals.

7. Intellectual Property

All content, features, and functionality of SleepWell — including but not limited to design, code, illustrations, sounds, text, and branding — are owned by SleepWell and protected by intellectual property laws. The ambient sounds included in the App are licensed for use within the App only.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • SleepWell is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or reliable.
  • We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
  • We are not liable for any health decisions made based on data from the App.
  • Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Health Liability Exclusion

SleepWell expressly disclaims all liability for any harm, injury, or adverse health outcome that may result from reliance on the App's data, scores, alerts, or recommendations. You assume all risk associated with using the App's health-related features.

9. Indemnification

You agree to indemnify and hold harmless SleepWell, its developers, and affiliates from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

10. Termination

  • You may stop using the App at any time by uninstalling it.
  • Active subscriptions must be cancelled through Google Play before uninstalling to avoid continued billing.
  • We reserve the right to modify, suspend, or discontinue the App at any time.
  • All your data is stored locally — uninstalling the App permanently deletes all data unless you have exported it.

11. Analytics

SleepWell includes optional, opt-in analytics (powered by TelemetryDeck, servers in Germany/EU). Analytics are disabled by default. If you opt in from Settings, anonymous usage signals are sent to help us improve the App. User IDs are double-hashed and cannot be traced back to you. You can opt out at any time. 12. Changes to These Terms

We may update these Terms from time to time. Changes will be indicated by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms. For significant changes, we will provide notice through the App.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of France, without prejudice to your rights as a consumer under the laws of your country of residence within the European Union.
